6. Order Refusal and Cancellation

If an Order is cancelled after payment, a full refund will be issued using the original payment method.
7. Your Statutory Right to Cancel (UK Consumer Contracts)
Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015.
Right to Cancel
If you are a consumer based in the UK, you have the legal right to cancel your Order within 14 days, without giving any reason.
The cancellation period ends 14 days after the day you receive the Goods, or where Goods are delivered in parts, 14 days after receipt of the final item.

Effects of Cancellation
If you cancel this contract, we will reimburse all payments received from you, excluding standard delivery costs, no later than 14 days after we receive the returned Goods or proof of return.
Refunds will be made using the original payment method unless expressly agreed otherwise.
Returning Goods

Exceptions to the Right to Cancel

Sealed items not suitable for return for health or hygiene reasons once unsealed

Goods that are inseparably mixed after delivery
These exclusions are lawful under Regulation 28 of the Consumer Contracts Regulations.
8. Promotions
Promotions may be subject to additional terms. Where Promotion terms conflict with these Terms, the Promotion terms will apply.
9. Intellectual Property
All content on this website—including artwork, images, text, logos, and designs—is owned by or licensed to Marcela Pepper.
You may not copy, reproduce, distribute, or use any content without prior written permission.
10. User Feedback and Submissions
By submitting Feedback, you grant us a non‑exclusive, royalty‑free right to use and display that content in connection with the Service.
You confirm that submitted content does not infringe third‑party rights or contain unlawful material.

20. Commissioned and Custom Artwork
This section applies to commissions, made‑to‑order, or personalised artwork, including artwork created to a client’s specifications, custom sizes, themes, colours, or personalised details.
Commission Process

A commission begins once details are agreed and the required deposit or full payment is received

The scope of work (subject, size, medium, timeframe, price) will be confirmed in writing before work begins

Any changes requested after approval may result in additional charges or time extensions
Payments for Commissions

Commissions may require full payment upfront or a non‑refundable 50% deposit, as stated at the time of booking

Remaining balances (if applicable) must be paid before final delivery or dispatch

Failure to complete payment may result in suspension or cancellation of the commission
Approval and Revisions

Reasonable revisions may be offered during agreed stages of the process

Once final approval is given, no further changes can be made

Minor variations between digital previews and final physical artwork are part of the handmade artistic process and do not constitute defects
Cancellation and Refunds (Custom Artwork)
Under UK law, the statutory 14‑day right to cancel does not apply to custom or personalised Goods.
This includes commissioned artwork made to your specifications.
Accordingly:

Commissions and custom artwork are non‑refundable once work has begun

Deposits are non‑refundable once the commission process has started

If cancellation occurs before work begins, any refund will be at our discretion, minus administrative costs
This exclusion is lawful under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013.
Artist’s Creative Discretion
By commissioning artwork, you acknowledge that:

Artistic style, interpretation, and technique are integral to the work

Exact replication of previous artworks is not possible

Final artwork will reflect the artist’s creative judgement within the agreed brief
Delivery of Commissioned Artwork

Delivery timelines are estimates and may vary due to the creative process or external factors

We are not responsible for delays outside our reasonable control

Risk passes to the customer upon delivery, unless the artwork arrives damaged or faulty
Copyright and Usage Rights (Commissions)
Unless otherwise agreed in writing:

Copyright remains with Marcela Pepper, even after purchase

You receive the right to display the artwork for personal, non‑commercial use

The artist reserves the right to photograph and display commissioned work for portfolio, website, social media, and promotional purposes
Commercial usage, reproduction, or resale rights require a separate written licence agreement.
Faulty or Damaged Commissioned Work
If commissioned artwork arrives damaged or faulty, your rights are governed by the Consumer Rights Act 2015.
You must notify us within 48 hours of delivery and provide supporting photographs where applicable.
